F | 还有某县花了520万元改造的体育场,刚完工试用阶段塑胶跑道就出现多处开胶、表层脱落,踩踏后底层材料外露。当地网友拍下视频,跑道像被撕开了一道道口子。修跑道是为了让人跑步,现在反倒让人摔跤——这钱花得冤不冤?该谁负责?从法律上讲,公园跑道的管理者,应该是城市管理的相关部门。《民法典》明确规定,公共场所的经营者、管理者未尽到安全保障义务,造成他人损害的,应当承担侵权责任。公园跑道出现安全隐患,管理者应当设置警示标志并及时维修。不修、不警示、不处理,出了事就要担责。

G | 今年7月,北京房山区一个公园的座椅老化失修导致老人摔伤,法院就认定公园管理方未尽到安全保障义务,判决承担赔偿责任。这不是“你倒霉”的问题,这是管理者的责任问题。跑者怎么办?作为普通跑者,我们能做什么?第一,跑的时候多留个心眼。

H | 夜跑时注意脚下,尤其是熟悉的路段反而最容易放松警惕。这次摔伤的跑者就是在自己常跑的公园出的事,最熟悉的地方,突发变化,往往也最危险。

I | 第二,发现问题及时反映。

J | 看到跑道破损、拱起、有异物,拍照发到本地政务平台或12345热线。早一天反应,可能就少一个人受伤。第三,受伤后保留证据维权。拍照、录像、留好就医记录。公共设施管理者有安全保障义务,该承担的责任不能让他们推掉。写在最后跑步是为了健康,不是为了受伤。

K | 一条好跑道,应该是跑者的“朋友”,而不是“陷阱”。修了跑道没人管,比不修更可怕。惠民工程,不能变成“害民工程”。跑者的安全,不该靠运气来保障。
